1. Acceptance of Terms

By accessing or using the services provided by DriveFolio ("we", "our", or "us") via our website drivefolio.in (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Service.

2. Description of Service

DriveFolio is an online platform that enables photographers to connect their Google Drive folder and build custom portfolio websites. The features generated include customizable themes, WhatsApp booking buttons, social link integration, and client inquiry forms.

3. User Accounts and Security

To utilize our Service, you must create an account by signing in through Google OAuth. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account by protecting your Google access credentials.
• Notify us immediately if you suspect any unauthorized activity or security breach on your DriveFolio account.
• Be solely responsible for all activities and content published under your portfolio link.

4. Google Drive Integration & Photo Ownership

DriveFolio integrates with Google Drive to display images:

• Ownership: You retain 100% of the ownership, intellectual property rights, and copyright to all photographs, images, and folders that you store in your Google Drive and select to display through our service. We do not claim any ownership rights over your content.
• License: By connecting your Google Drive folder, you grant DriveFolio a worldwide, royalty-free, non-exclusive license to retrieve, display, scale, and render your images solely for the purpose of generating your public portfolio website.
• Read-Only Limit: DriveFolio only requests read-only scopes. We do not modify, delete, or upload files to your Google Drive.

5. Acceptable Use & Content Standards

You agree not to use the Service to display or distribute content that:

• Is illegal, threatening, defamatory, abusive, harassing, or invasive of another's privacy.
• Infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contains explicit adult content, pornography, violence, or hate speech.
• Contains software viruses, malware, or any code designed to disrupt or damage the Service.

We reserve the right, but have no obligation, to monitor portfolios and remove content or suspend accounts that violate these guidelines.

6. Subscriptions, Billing, and Refunds

• Pricing Plans: We offer free trial periods followed by monthly or annual subscription plans as outlined on our pricing page.
• Billing: Payments are billed in advance on a recurring monthly or annual basis using Razorpay. By choosing a paid plan, you authorize us to charge your payment method for the recurring fee.
• Cancellations: You can cancel your subscription at any time through the dashboard settings. Your portfolio will remain active until the end of the current paid billing cycle.
• Refunds: Payments are non-refundable, except as required by applicable consumer law.

7. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DRIVEFOLIO MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

IN NO EVENT SHALL DRIVEFOLIO, ITS DIRECTORS, OR ITS EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

9. Termination

We may suspend or terminate your account and your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or harms our business interests. You may close your account at any time by requesting deletion in the settings dashboard.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in India.
